At nine he runs away from his home in east Texas in 1866 and turns to criminal activities in order to eat. At twelve he joins the Luke Jacoby gang and holds their horses while they rob banks.

At fourteen everyone in the Jacoby gang except him is killed in a bank robbery in Garden City, KS. He is sentenced to ten years of hard labor at the Kansas State Penitentiary.

At twenty-two, now full-grown and muscular, he is released from prison for good behavior. He is determined to be honest and never go back to prison.

He goes to work for Roy Olson, the owner of a local livery. He tells Mr. Olson his name is 342, which was his number in prison; but Mr. Olson, who is hard-of-hearing, thinks he said "Ty Fortune" and that becomes his name.
